House Bill 489: Use of Service Animals

Texas peace officers need to be aware that a new law was passed that adds protection for persons who use service animals. In 2013, the 83rd Texas Legislature passed House Bill 489 relating to the rights and responsibilities of persons with disabilities. Texas law and federal Americans with Disabilities Act (ADA) direct all public places to allow service animals accompanied by a person who is blind or has other disabilities. There are a growing number of veterans suffering from post-traumatic stress disorder (PTSD) and traumatic brain injuries (TBI) whose disability may not be obvious, but who are impacted by this new law.
